Redundancy and TUPE

Employees have statutory protection against being arbitrarily dismissed. This can be as a result of a business being transferred to new ownership or the demand for work not continuing. In either of these situations an employer can reach a voluntary agreement with the employee to accept a payment and waive all potential rights they might have. This is a compromise agreement and to be effective the employee must take independent legal advice before signing to certify they fully understand the rights that they are giving up and the terms of the payment being made.
